These terms govern the supply of Resort Cams, the Real View live-view camera service (the “Service”) by Real View (“we”, “us”) to the customer named on the order (“you”). By placing an order or using the Service you agree to these terms. Please read them carefully.
1. About us
Resort Cams is a service provided by Real View. You can contact us at support@real-view.tv.
2. The Service
The Service consists of some or all of the following, as set out in your order:
- the supply of one or more plug-and-play cameras for you to install at your location;
- live streaming of each camera, and automatic capture of still images at a set interval;
- secure storage of captured images for a rolling period;
- access to an online control panel from which you can view your cameras, embed the live view on your website, connect a YouTube channel for simulcasting, and produce highlight clips and timelapses;
- inclusion of your live view on the Real View viewing channel and associated distribution; and
- optional extras described on your order.
We may improve or change how the Service works from time to time, provided the changes do not materially reduce the Service you have paid for.
3. Quotes, orders and term
A quote is not an offer and we may withdraw or revise it before you accept. A contract is formed when we confirm your order in writing. Unless your order says otherwise, each camera is supplied on a minimum term of twelve (12) months. After the minimum term the Service continues on a rolling basis until cancelled in line with clause 12.
4. Charges and payment
- Charges are as set out in your order — typically a one-off charge for the camera kit, plus a recurring per-camera charge billed monthly in advance.
- Unless stated otherwise, charges are exclusive of VAT, which will be added where applicable.
- Recurring charges are payable by the method agreed at sign-up. If a payment fails or is more than 14 days overdue, we may suspend the Service (including the live view, website embed and YouTube simulcast) until payment is received.
- Camera-kit charges are non-refundable once the kit has been dispatched, except as required by law.
5. Installation and your location
The camera is supplied for you to install. So that it can run, you agree to:
- mount the camera in a safe, suitable position with a clear view;
- provide a network connection with internet that the camera can reach; the camera is powered over that connection (PoE), or via a PoE injector we can supply;
- obtain any permissions, consents or licences needed to install and operate a camera at the location (including from the property owner or landlord); and
- position the camera so that it captures a scenic or public-facing view and does not point at areas where people have a reasonable expectation of privacy.
We can advise on positioning, but installation and its safety are your responsibility unless your order states that we are attending to install.
6. Equipment
Where your order states that the camera kit is a one-off purchase, the hardware is yours once paid for. Where your order states that equipment is provided on loan or rental, it remains our property, and on termination you agree to return it or give us access to recover it. In all cases the Real View platform, software and services that run the camera remain ours and are provided under these terms for the duration of your subscription.
7. Live view and availability
We aim to keep the Service running reliably but we do not guarantee uninterrupted or error-free live streaming. The Service depends on your location’s power and internet connection, on third-party networks and platforms (such as YouTube), and on hosting providers, none of which we fully control. If the connection drops, the camera is designed to hold captured images locally and upload them when the connection returns, so a temporary outage should not lose your clips. We may occasionally suspend the Service for maintenance and will try to give reasonable notice where practical.
8. Publishing and distribution of your view
By enabling the relevant features, you instruct and authorise us to publish and distribute your live view and the clips derived from it across the channels you switch on — including the embed on your own website, simulcasting to your YouTube channel, and inclusion on the Real View viewing channel and the calm-viewing screens we supply to third-party venues. You confirm you have the right to have the view captured and shown publicly. You may switch off any distribution channel by giving us reasonable notice, after which we will stop new distribution through that channel, though copies already downloaded or cached by third parties are outside our control.
9. Footage, clips and intellectual property
Subject to you having paid the charges due, we grant you a licence to use the highlight clips and timelapses you produce through the Service for your own purposes, including marketing, PR and social media. The Real View platform, software, branding, viewing channel and the way our clips are produced remain our intellectual property. You grant us a licence to host, reproduce, adapt (for example to create clips and timelapses) and distribute your view across the channels you enable, and — unless you tell us otherwise in writing — to feature your view as a reference example of the Service. If your order is on a “founding” or discounted basis, permission to feature your view as a reference is a condition of that rate.
10. Data protection and people in view
Our handling of personal data is described in our Privacy Policy. Resort Cams are intended to show a scenic, public-facing view. Where a camera could capture identifiable individuals and you determine why and how that footage is used, you are the data controller for it and we act as your processor; in that case you are responsible for positioning the camera appropriately, for any signage required, for informing people where necessary, and for having a lawful basis for capturing and publishing the view. Each party agrees to comply with applicable data protection law.
11. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that:
- we are not liable for loss of profit, loss of business, loss of goodwill, or any indirect or consequential loss;
- we are not liable for footage that is missing, incomplete or lost, or for interruptions to the live view or third-party platforms, due to matters outside our reasonable control (including loss of power or internet at your location, or a third-party platform’s outage or policies); and
- our total liability arising out of the Service in any 12-month period is limited to the charges you paid for the Service in that period.
The Service is provided to businesses; consumer rights that cannot be excluded are unaffected.
12. Termination and suspension
Either party may end the contract at the end of the minimum term, or afterwards, by giving 30 days’ written notice. Either party may end the contract immediately if the other commits a serious breach that is not put right within a reasonable time, or becomes insolvent. On termination, charges accrued up to the end date remain payable, the live view, website embed, YouTube simulcast and channel inclusion end, and any loaned equipment must be returned. You should download any clips you wish to keep before the contract ends.
13. Events outside our control
We are not responsible for failure or delay in performing the Service caused by events outside our reasonable control, including power or network failures, extreme weather, acts of third parties, or interruption to hosting, connectivity or third-party platform services.
14. General
- We may transfer our rights and obligations to another organisation; your rights under these terms are not affected.
- If we do not insist on strict performance, that is not a waiver of our rights.
- If any part of these terms is found to be unenforceable, the rest continue to apply.
- These terms and your order form the entire agreement between us.
- A person who is not a party to the contract has no rights to enforce it.
15. Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
